Terms of Service for Kibun

These Terms of Service ("Terms") govern your use of Kibun ("the App"), a mood tracking and journaling application. Please read them carefully.

By downloading, accessing, or using Kibun, you agree to be bound by these Terms. If you do not agree, please do not use the App.

You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction) to use Kibun. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian.

By using Kibun, you confirm that you meet these requirements and that you are not barred from using the App under any applicable law.

Kibun is anonymous-first. You can use the App without creating an account, in which case your entries are stored on your device.

If you choose to create an account to sync across devices:

• You are responsible for keeping your login credentials secure.
• You are responsible for activity that occurs under your account.
• You agree to provide accurate information and to keep it current.
• You may delete your account at any time from within the App, or via our account deletion page.

Your entries belong to you. Mood check-ins, notes, habits, and any other content you create in Kibun remain yours.

You grant us a limited, non-exclusive licence to store, process, and display your content solely for the purpose of operating the App for you — for example, generating your insights and reports, and syncing your data across your own devices. This licence exists only so the App can function; we do not use your content to train models sold to third parties, and we do not sell your content.

You can export your data at any time, and deleting your account removes it as described in our Privacy Policy.

Kibun is free to use. Some features are available through an optional paid subscription, Kibun Pro.

• Billing: Subscriptions are sold and billed by the Apple App Store or Google Play, not by us directly. Current pricing is shown in the App and on your store listing, in your local currency.
• Free trial: Where a free trial is offered, it converts into a paid subscription automatically unless you cancel before it ends.
• Auto-renewal: Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the end of the current period.
• Cancellation: Manage or cancel your subscription in your Apple ID settings or in Google Play. Uninstalling the App does not cancel a subscription.
• Refunds: Refunds are handled by Apple or Google under their own policies. We cannot issue refunds on their behalf.

If a Pro feature changes materially, we will describe the change in the App or in these Terms before it takes effect where practicable.

You agree not to:

• Use the App for any unlawful purpose, or in violation of these Terms.
• Attempt to gain unauthorised access to the App, other people's data, or our systems.
• Reverse engineer, decompile, or attempt to extract the source code of the App, except where such restriction is prohibited by law.
• Interfere with, disrupt, or place undue load on the App or its infrastructure.
• Resell, sublicense, or commercially exploit the App or any part of it.

Kibun is a self-reflection and mood-awareness journal. It is a wellness and lifestyle tool — not a medical device.

Kibun does not provide medical advice, diagnosis, or treatment, and is not a substitute for care from a qualified professional. Insights, patterns, reports, and scores shown in the App are informational reflections of the data you enter. They are not assessments of your health and should not be relied upon as such.

Never disregard professional advice, or delay seeking it, because of something you read in the App.

If you are in crisis, contact your local emergency services or a licensed professional immediately.

The App — including its name, design, artwork, the Shiba character, text, and software — is owned by us and protected by intellectual property laws. These Terms grant you a personal, non-transferable, revocable licence to use the App for your own non-commercial purposes. No other rights are granted.

We work to keep Kibun available and functioning, but we do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue features at any time.

We may suspend or terminate your access if you materially breach these Terms. You may stop using Kibun at any time by deleting the App and, if you have one, your account.

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of or inability to use the App.

Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid us for the App in the twelve months before the claim, or USD 50.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.

These Terms are governed by the laws of the country in which the developer is established, without regard to its conflict-of-law provisions.

Your consumer rights are unaffected. If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protection laws, you keep the benefit of any mandatory provisions of the law of your country of residence, and you may bring proceedings in your local courts.

We may update these Terms from time to time. When we do, we will revise the "last updated" date at the top of this page. If a change is material, we will make reasonable efforts to notify you in the App. Continuing to use Kibun after a change takes effect means you accept the revised Terms.
